Online Poker in Ukraine — Dated Regulatory and Wartime Research

Ukraine has an express online-poker licence category. Understanding it requires separate checks of the operator's authorization, the player's eligibility, the regulator's transition and the wartime measures that apply.

KRAIL to PlayCity: the dates do different jobs

The Rada bill record resolves the numbering: Bill 9256-d, registered on 5 April 2024, became Law 4116-IX of 4 December 2024. Its main commencement was 1 April 2025, with exceptions in section II. Subsequent Cabinet instruments addressed the agency's establishment and functions.

For an existing licence, the key point is section II(2) of Law 4116-IX: KRAIL licences and covered permits valid when the law took effect continued for their issued terms. The agency change alone did not cancel them. A later termination or expiry still needs an individual check.

Later than the April cutoff: paragraph 1 of Resolution 505, amended by Resolution 1133 of 17 September 2026 and displayed in the 19 September revision, places direction and coordination with the Cabinet and says the Prime Minister coordinates PlayCity's activities. Paragraph 3 still includes proposals to the Ministry of Digital Transformation on policy formation. This specific update does not mean the ministry has no continuing policy role.

What the actual poker register shows

PlayCity's official open-data page links a distinct Internet-poker organizer register. Its retrieved records on include these entries. The May grants and August expiry are later than the original cutoff.

These records demonstrate use of the category and replace the unsupported statement that no standalone poker licensee had been located. A register may retain expired or terminated entries. Presence alone does not establish current validity; a blank termination field also does not independently guarantee that no later decision exists.

Check the legal entity and company identifier, activity, issue and end dates, recorded website or application, and later decisions. This review did not authenticate every underlying decision or test account access and game availability. The observations are not an April 2026 register snapshot.

Age, exclusion and concrete limits

Article 18 sets a minimum age of 21 and further exclusions, including the restricted-access register and other legal restrictions. Article 16 provides for self-exclusion for six months to three years, qualifying family applications and court decisions. Self-exclusion is a formal restriction, not simply an account preference.

Article 18(9) requires players to set spending and time limits within regulatory ceilings. Ministry Order 207 of 26 December 2025, officially published on 16 January 2026, supplies concrete limits and expressly includes online poker.

The periods must be set together. Spending limits may change no more than once a month. Continuous participation is capped at two hours followed by a break of at least 15 minutes; time starts with a bet and is measured to the second.

These ceilings are not recommendations or safe gambling levels. They do not establish what an individual can afford. This document review did not test compliance by every operator.

Wartime instructions and technical implementation

Decree 234/2024 of 20 April 2024 brought the attached National Security and Defence Council decision into force. Paragraph 1 directs Cabinet measures on advertising, accounts, time, spending and monitoring. Paragraph 2 directs the Commander-in-Chief and leadership of other legally established military formations to introduce a wartime prohibition on service members accessing gambling establishments or participating in Internet gambling.

The decree does not itself establish a completed, universal check against military records at every login. Law 768-IX, section XI(9), as added by the reform, provides for wartime military restrictions under a Cabinet-established procedure.

On , PlayCity announced consultation on a draft procedure for checks through restriction and military registers using Trembita data exchange. It described the military register as under development then. This supports the proposal's status at that date, not a conclusion about enactment or deployment at every later date.

Separately, PlayCity's State Online Monitoring System description addresses transaction reporting and oversight. Ministry Order 61 of 27 March 2026 sets an identifier algorithm for transmitting player information to that system in non-personalized form. Its inspected text was officially published on , after the original cutoff. Neither source proves universal military-access blocking. Unverified implementation is not permission to disregard applicable restrictions.

Player winnings and operator income have different tax bases

Players: do not assume tax applies only to session profit

The Tax Service's 24 April 2026 explanation covering gambling winnings, including Internet gambling describes 18% personal income tax and a 5% military levy on the whole amount paid as winnings, with organizer withholding at payout. This is guidance on covered winnings, not a universal calculation for every account movement or personal circumstance.

Tax Code article 170.6 supplies the underlying rules. Paragraph 170.6.3 addresses non-lottery winnings and prizes; 170.6.5 addresses taxation on payment. The expense rule in 170.6.4 specifically concerns lotteries or other draws requiring prior purchase of participation. Its wording should not be generalized to every conceivable gambling transaction.

A returned stake, transfer of existing funds, prize and annual net profit are not interchangeable. The actual payment and its records matter. Residence, foreign-source income, reporting and relief need separate assessment; this page neither promises offshore withholding nor calculates an individual liability.

Organizers: income after payouts is not gross stakes

In the Tax Service's published Code text, article 136.4.2 sets 18% for covered gambling income, excluding slot-machine halls, reduced by payments made to players. Article 136.4.1 separately sets 10% for slot-machine-hall income. Article 141.5.1 provides for these charges alongside corporate profit tax at the article 136.1 rate.

Calling the 18% base simply “turnover” conceals the statutory deduction for payouts. It is also separate from the player's winnings tax. The earlier draft-bill forecasts and claim that Bill 8079 itself set the described rates are not retained.

Documented poker history

PokerStars' 21 August 2009 coverage documents the EPT Kyiv Sports Poker Championship in progress. Ukraine's tournament history should therefore not be reduced to an EAPT-only narrative.

For a completed result, WSOP's official 4 June 2011 report records Eugene Katchalov winning its $1,500 Seven-Card Stud event in Las Vegas and his first WSOP bracelet. The report identifies Kyiv as his birthplace. Birthplace, nationality, residence and country of play are different facts; the result does not establish a domestic cash-game market.

These records do not establish a current Ukrainian calendar, prove that no events take place, or predict a major tour's return. The previous EAPT chronology, current earnings totals and sweeping availability statements lacked the necessary primary support and have been removed.

Useful records and support

Use the official register links and dated instruments to evaluate authorization claims. For a dispute, preserve the legal entity, terms, licence details, correspondence and transaction records without publishing identity documents.

PlayCity's official website links its restriction application and responsible-gambling information. A limit or licence does not guarantee protection from harm, repayment problems or loss.

Frequently Asked Questions

Does Ukraine have an online-poker licensing category?

Yes. Articles 2 and 42 of Law 768-IX expressly provide for organizing poker on the Internet under a dedicated licence. That establishes the category, not permission for every poker website or every player. The legal entity, relevant licence, registered service and player eligibility still matter.

Are Law 4116-IX and Bill 9256-d different reforms?

They are the enacted-law and bill identifiers for the same legislative process. Parliament's record links Bill 9256-d, registered on 5 April 2024, to Law 4116-IX, adopted on 4 December 2024. The law's main commencement was 1 April 2025, subject to stated exceptions. Separate Cabinet instruments created PlayCity and provided for KRAIL's liquidation.

Did the replacement of KRAIL invalidate all its licences?

No. Section II, paragraph 2 of Law 4116-IX continued KRAIL licences and covered permits that were valid when the law took effect for their issued terms. That rule does not override a particular licence's later termination or expiry. Current status needs the relevant register and decisions.

What player limits apply to online poker in the inspected rules?

Ministry Order 207 of 26 December 2025, officially published on 16 January 2026, includes online poker. Spending ceilings are 15%, 25% and 40% of the player's self-declared average monthly income over a day, week and month. Corresponding time ceilings are 6, 21 and 100 hours. Continuous play is limited to two hours followed by a break of at least 15 minutes. These are regulatory ceilings, not recommended or safe levels of gambling.

Does the 2024 decree prove automatic military blocking at every login?

No. Decree 234/2024 brought into force an NSDC decision directing the Cabinet and military leadership to take specified measures. In March 2026, PlayCity described a proposed exchange between restriction and military registers. The separate monitoring system and player-identifier rules do not by themselves prove universal deployment of that access control. Unverified deployment does not remove the underlying restrictions.

Is the player tax calculated from net poker profit?

Do not assume that. The Tax Service's 24 April 2026 explanation describes 18% personal income tax and a 5% military levy on the whole amount paid as gambling winnings, with withholding by the organizer. Tax Code article 170.6.4 also disregards expenses for its specified lotteries or draws requiring prior purchase of participation. A particular payment, returned stake, foreign income or personal circumstances needs separate assessment.

Do historical tournament results establish games available today?

No. PokerStars documented EPT Kyiv in August 2009, and WSOP's official June 2011 report records Kyiv-born Eugene Katchalov's Seven-Card Stud bracelet win in Las Vegas. These records establish historical events and results. They do not authenticate a current Ukrainian venue, tournament calendar, licence or access policy.

What changed in this review

We corrected the national structure, reform numbering and regulator chronology; replaced an unsupported licence-absence claim with dated records; and separated wartime instructions, player limits and monitoring. Tax bases and poker history now follow the inspected sources.

Unnecessary personal allegations, unsupported leadership and brand-revocation narratives, cryptocurrency detours and the claim-bearing regulator illustration were removed. Remaining gaps include later individual decisions, a complete enforcement survey, technical-compliance testing, current game availability and individual legal or tax conclusions.

Each country has its own legal framework and research dates.
