A legal change after the original research cutoff

MP 1.394/2026 makes older descriptions of Brazil's fixed-odds licensing market incomplete. The Congress record is still at an early stage. This page does not certify a particular poker platform, establish individual eligibility or claim that every subsequent implementing act or judicial challenge has been checked. A decision about a specific product or person's position needs current Brazilian legal advice.

What changed on 25 September 2026

MP 1.394, Articles 1–3, prohibits fixed-odds betting exploitation, offering, intermediation and advertising in Brazil, including offers by overseas businesses to people in Brazil. Its scope covers sports events and virtual online-game events and extends to states and the Federal District. Other lottery modalities authorized by law are expressly outside that prohibition.

Article 30 gives the measure effect on publication. The official gazette edition is dated 25 September 2026. A provisional measure has force of law while undergoing the applicable congressional process; it is not simply an unadopted bill. On 27 September, the Congress docket showed the measure awaiting committee-member appointments, with an initial deliberation period from 25 September to 23 November 2026. That is a procedural record, not a forecast of its eventual outcome.

Articles 8–11 prescribe restitution, reporting and continuing obligations. Article 17 creates a specific advertising exception for content published before the measure that contains betting advertising incidentally. Article 29 repeals substantial parts of the earlier statutes while retaining rules for facts during the authorized period and for the transition. These provisions must be read together; the thirty-day period is not an unrestricted extension of the previous business model.

Enforcement powers and individual exposure

The new measure addresses several different actors. Articles 14–23 concern payment institutions, advertising, Internet services, app distribution and blocking. Article 23 allows the Finance and Justice ministries to request blocking or redirection of sites offering fixed-odds betting, with roles for Anatel and CGI.br. This is a description of statutory powers, not a verified count of blocks or completed enforcement actions.

Separately, Decree-Law 3.688/1941, Article 50, addresses establishing or operating games of chance in public or publicly accessible places. Paragraph 3 includes games in which winning and losing depend exclusively or mainly on chance. Paragraph 2 provides a fine for participating as a bettor and expressly includes Internet participation. Whether an actual poker arrangement falls within those provisions needs its facts and applicable legal interpretation; the SPA classification alone does not decide a criminal case.

The former page's “historically very low” player-risk assessment and assertion that no cases had been located are withdrawn. This review is not a complete prosecution database or a survey of all state-level rules. Unrelated sports-betting, money-laundering or match-fixing allegations cannot establish a poker player's likelihood of prosecution.

Operator obligations and a player's income are different

Receita Federal's Cosit 2/2025, dated 16 January 2025, answered a Brazilian resident who specifically mentioned online poker tournaments. Its conclusion separates Brazilian-source game income linked to performance and treated as remuneration, foreign-source game prizes, and the then-existing fixed-odds category. It does not give a single rate for everything called poker.

For the first category, the ruling describes withholding under the monthly progressive table as an advance against the annual return. For the foreign-source prizes addressed, it describes monthly carnê-leão and inclusion in the annual return, without a legal basis for offsetting losses or deducting betting expenses in that calculation. These are the ruling's stated categories, not a determination of the source, receipt date or classification of a reader's income.

Receita's fixed-odds and fantasy-sport service page, last modified 7 July 2026, describes the former specific annual tax mechanism. It predates MP 1.394's Article 29, which repeals Law 14.790 Article 31 and contains a savings clause for specified earlier and transition matters. Article 10 also preserves operators' tax and other obligations from their authorized period. An operator levy is not an individual winnings tax, and neither a tax filing nor an old rate establishes permission to offer or play a game. Current treatment needs the relevant period, income source and taxpayer circumstances.

Two documented pieces of Brazilian poker history

WSOP's 30 June 2008 report records Alexandre Gomes winning Event 48, the $2,000 No-Limit Hold'em event, and becoming Brazil's first bracelet winner. It records a $770,540 first prize. This is a specific organizer result, not a present-day ranking or estimate of the number of Brazilian players.

In its 29 November 2025 BSOP Millions closing coverage, circuit sponsor PokerStars records 714 entries in the Championship in São Paulo and Alen Fillipi's victory. Entries are not necessarily unique people. The completed event documents Brazil's live tournament history; it does not establish current venue permission, a future schedule or the legal treatment of remote play.

Research and safety resources

For a present-day claim, identify the exact game, the relevant date and the authority behind it. Preserve a dated copy of any authorization or legal claim rather than treating a familiar brand or an older licence as conclusive.

Frequently Asked Questions

Is online poker legal in Brazil after the September 2026 change?

A blanket answer would miss both the product and the legal transition. MP 1.394 of 25 September 2026 prohibits fixed-odds betting operations and sets a closure timetable. Earlier SPA guidance excluded skill poker and player-to-player games from that regulated category, but treated single-player video poker differently. The measure does not expressly name player-to-player poker, and the sources checked here do not establish a post-measure classification or personal permission for every poker arrangement.

Is MP 1.394 merely a proposed bill?

No. Its Article 30 gives it effect on publication, recorded as 25 September 2026. It is a provisional measure with force of law, subject to congressional consideration. The Congress record checked on 27 September showed it awaiting appointment of committee members, with an initial deliberation period ending 23 November 2026. That record does not establish conversion into a permanent law or predict a later vote or court ruling.

Does a previous SPA licence prove that poker is approved?

No. Under the earlier framework, SPA technical guidance excluded skill, multi-player and peer-to-peer games from fixed-odds online games and said excluded games could not be offered within the same regulated betting system. A licence for that system was not approval of a separate poker product. The September 2026 measure also provides for the extinction of fixed-odds authorizations after a thirty-day transition.

Can this guide establish that individual poker players face no prosecution risk?

No. Article 50 of the Criminal Contraventions Law addresses games of chance in public or publicly accessible places, and paragraph 2 expressly includes Internet participation in its bettor provision. Whether a specific poker game falls within that law depends on its characteristics and the applicable legal interpretation. The older statement that no player cases had been found did not establish immunity or a reliable risk estimate and has been removed.

Is the fixed-odds betting tax rate a universal poker tax?

No. Receita's January 2025 Cosit ruling distinguishes Brazilian-source performance-related game income, prizes from games abroad and the then-existing fixed-odds tax category. Its consultation specifically mentions poker tournaments. The September 2026 measure repeals the fixed-odds statute's Article 31 while preserving specified earlier and transition obligations. Income source, taxpayer residence, game classification and the relevant period must be established before applying a tax rule.

What does Brazil's live tournament history prove?

Organizer records establish completed results: Alexandre Gomes won Brazil's first WSOP bracelet in 2008, and PokerStars reported 714 entries in the 2025 BSOP Millions Championship in São Paulo. Those records describe particular events. They do not verify a venue's present authorization, a future tournament calendar or permission to play online from Brazil.

What changed in this review

We replaced a broad “poker is outside the licensing net” conclusion with the actual category distinctions and the September 2026 statutory transition. Unpinned claims of settled STF/STJ poker case law, old operator-list totals, a national no-prosecution assessment and unrelated alleged-crime summaries were removed.

We also removed the digital-asset tax detour, unsupported live-event totals and suggestions of an ongoing annual venue calendar. This correction does not supply a crypto or payment route, a current operator recommendation, a full state-law survey or a personal tax calculation.
